2. Sole Exception: Service Non-Delivery

EXCEPTION CASE

Refunds may only be considered in the following specific circumstance:

If Adswin.net completely fails to deliver the advertising service you paid for, and we are unable to provide the service within a reasonable timeframe, you may be eligible for a refund.

2.1 What Qualifies as "Service Non-Delivery"

For a refund request to be considered under this exception, ALL of the following conditions must be met:

  1. Complete Failure: The service was not delivered at all (not just underperforming)
  2. Technical Issue: The failure is due to a technical issue on our platform
  3. Timely Notification: You notify us within 7 days of the payment
  4. Proof of Payment: You provide valid proof of payment
  5. No Alternative: We are unable to provide an alternative solution

2.2 What Does NOT Qualify

The following situations do NOT qualify for refunds:

  • Ad Performance: Poor ad performance, low click-through rates, or low conversions
  • User Errors: Mistakes in ad creation, targeting, or bidding
  • Changed Mind: Deciding you no longer want the service
  • Policy Violations: Ads rejected due to policy violations
  • Temporary Issues: Temporary platform outages or maintenance
  • Expectation Mismatch: Not achieving expected results or ROI
  • Competitive Factors: Other advertisers outbidding you

3. Refund Request Process

REFUND REQUEST PROCEDURE

If you believe you qualify for a refund under the sole exception, follow this process:

3.1 Step-by-Step Process

  2. Provide Details: Include:
    • Your account username
    • Invoice number(s)
    • Payment transaction ID
    • Detailed description of the issue
    • Proof of non-delivery
  3. Investigation: We will investigate within 14 business days
  4. Decision: We will notify you of our decision
  5. Processing: If approved, refunds are processed within 30 days

3.2 Refund Method

Approved refunds will be issued:

  • Account Credit: In some cases, refunds may be issued as account credit

4. Dispute Resolution

  • Collection efforts for the disputed amount plus fees
  • Reporting to credit bureaus and collection agencies

5. Special Circumstances

5.1 Duplicate Payments

If you accidentally make a duplicate payment, contact us immediately. We will verify and refund duplicate payments within 30 days.

5.2 Fraudulent Transactions

If you believe a transaction on your account is fraudulent, contact us immediately at security@adswin.net. We will investigate and take appropriate action.

5.3 Legal Requirements

In some jurisdictions, consumer protection laws may provide rights that cannot be excluded. This policy does not exclude any statutory rights you may have under applicable law.

6. Account Termination and Balances

6.1 Account Closure

If you choose to close your account:

  • Any remaining balance is forfeited
  • No refund will be issued for unused funds
  • All outstanding invoices must be paid

6.2 Inactive Accounts

Accounts that have been inactive for more than 12 months may be subject to administrative fees or closure. Any remaining balance in inactive accounts may be forfeited.
